These Terms govern your use of MossMC. By creating an account you agree to them. If you do not agree, do not use the service.

1. Who you are contracting with

MossMC ("we", "us") is operated by Isaiah (sole proprietor), trading as MossMC. These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in North Carolina, and you and we each consent to that venue.

We are a small independent operator, not a large company. That is not a disclaimer of responsibility, but it is context for the service levels described below.

2. Eligibility and age

You must be at least 13 years old to hold an account. If you are under 18, you may only use MossMC with the involvement of a parent or legal guardian, and that parent or guardian must be the one who authorises any payment.

If you are a parent or guardian and a purchase was made on your card without your permission, contact us at [email protected] before filing a chargeback. We will almost always resolve it directly and faster.

We do not knowingly collect information from children under 13. If we learn that an account belongs to someone under 13, we will close it and delete the associated data.

3. Your account

You are responsible for what happens under your account, including anything done by someone you gave access to. Keep your password to yourself. Tell us promptly at [email protected] if you believe your account has been accessed by someone else.

One person, one account. Do not create additional accounts to evade a suspension, to claim beta access codes more than once, or to redeem gift codes intended to be one-per-person.

You may link a Minecraft account to your MossMC account. Doing so tells us that Minecraft account's UUID and username, and lets purchases you make here apply to you in game.

4. The service

MossMC provides Minecraft server hosting and a connected network of community servers. Servers are provisioned on our infrastructure and managed through our control panel.

We try hard to keep servers online and we monitor for failures, but we do not offer a guaranteed uptime figure and we do not offer service credits for downtime. Hardware fails, upstream providers have outages, Minecraft releases break plugins, and sometimes we make mistakes. If an outage is our fault and it is significant, talk to us — we would rather sort it out than argue about whether a document required us to.

We may change, add or remove features. If a change materially reduces something you have paid for, we will tell you before it takes effect where we reasonably can.

5. Tokens

Tokens are a prepaid balance used to pay for server plans, ranks and cosmetic items on MossMC.

  • Tokens are not money, not a deposit, not a stored-value instrument, and carry no cash value.
  • Tokens cannot be transferred between accounts, sold, or exchanged for cash.
  • Tokens do not expire while your account is open and in good standing.
  • If your account is closed for a breach of these Terms, any remaining token balance is forfeited.
  • If you close your account yourself, any remaining balance is forfeited. Spend it first.

We may change what things cost in tokens. Price changes are not retroactive: a server plan you have already paid for runs to the end of its paid period at the price you paid.

6. Payment and refunds

Payments are processed by Stripe. We do not receive or store your card number. Stripe's own terms and privacy policy apply to the payment itself.

Tokens, ranks and cosmetic items are delivered immediately and are non-refundable once delivered. A token purchase credits your balance the moment payment clears; a rank applies to your Minecraft account as soon as you buy it. There is nothing to return.

We may still issue a refund at our discretion — for example if you were charged twice, if a purchase failed to deliver, or if something on our side clearly went wrong. Doing so once does not oblige us to do it again.

Server plans are paid in advance for a period. Cancelling before the end of a period stops future charges; it does not refund the current one.

Chargebacks. If you dispute a charge with your bank rather than contacting us, we will suspend your account and any servers on it while the dispute is open. If the dispute is resolved against us, the account stays closed. Please email [email protected] first — it is faster and we are reasonable.

7. Ranks, cosmetics and gift codes

Ranks and cosmetic items are a licence to use them on the MossMC network. You do not own them, and they exist only while the network does.

Buying a rank grants it on the account you link. Gift codes may be redeemed once, by someone other than the buyer, and may be subject to a holding period before they become redeemable. We may cancel an unredeemed gift code if the payment that funded it is reversed.

If we remove or change a cosmetic item — because it breaks in a Minecraft update, infringes someone's rights, or has to go for another reason — we will try to offer something comparable, but we do not guarantee any specific item remains available forever.

8. Your servers and your content

You keep ownership of the worlds, files, plugins and configuration you upload. You grant us only the permission we need to host and operate the service: to store your files, transmit them to your players, and make backups.

You are responsible for what you host. That includes making sure you have the right to use any plugin, mod, resource pack or world you upload, and that what you run complies with the Acceptable Use Policy and with Mojang's Minecraft End User Licence Agreement.

Backups are your responsibility. We take backups for our own operational purposes and we will help you restore where we can, but you should keep your own copies of anything you would be upset to lose.

If you believe content hosted on MossMC infringes your copyright, email [email protected] with enough detail to identify the work and where it is. We will investigate and remove infringing material.

9. Suspension and termination

We may suspend or close an account, or take down a server, if:

  • it breaches these Terms or the Acceptable Use Policy;
  • it is being used to harm other users, our infrastructure, or third parties;
  • payment fails or is reversed;
  • we are required to by law.

Where the situation allows it, we will tell you what is wrong and give you a chance to fix it first. Where it does not — active abuse, an attack, or content we cannot lawfully host — we will act immediately and explain afterwards.

You may close your account at any time. Tell us at [email protected] and we will delete it and its data, subject to records we must keep for tax and fraud purposes.

10. Disclaimers and limits

The service is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, our total liability to you for any claim relating to MossMC is limited to the greater of (a) the amount you paid us in the three months before the claim arose, or (b) fifty US dollars. We are not liable for lost profits, lost data, lost players, or indirect or consequential losses.

Some jurisdictions do not allow these limits. Where that is the case, the limits apply to the fullest extent permitted, and nothing here excludes liability for fraud, gross negligence, or anything else that cannot lawfully be excluded.

11. Relationship to Mojang and Microsoft

MossMC is not an official Minecraft service. It is not approved by or associated with Mojang Studios or Microsoft. Minecraft is a trademark of Mojang Studios. Your use of Minecraft itself is governed by Mojang's own EULA, and nothing here changes that.

12. Changes to these Terms

We may update these Terms. If a change is material, we will notify account holders by email or an in-dashboard notice before it takes effect, and the current version and date will always be shown at the top of this page. Continuing to use MossMC after a change takes effect means you accept it.

13. Everything else

If any part of these Terms is unenforceable, the rest still applies. Our not enforcing something on one occasion does not waive it. You may not transfer your rights under these Terms without our consent; we may transfer ours if the service is sold or reorganised, and will tell you if that happens.

These Terms, together with the Acceptable Use Policy and Privacy Policy, are the whole agreement between us about MossMC.
